Terms of Service

Last updated: July 29, 2026

These Terms of Service (“Terms”) govern your access to and use of Cascade websites, apps, and related services (the “Services”). By creating an account or using the Services, you agree to these Terms and our Privacy Policy.

If you do not agree, do not use the Services. Contact support@cascadedept.com with questions.

1. The Services

Cascade provides tools that help music producers create video edits from beats, footage, and optional video styles, including previews, exports, Creative DNA / Creator Profile features, memberships, and related functionality. Features may change, be limited by plan, or be offered as experiments or early access.

2. Eligibility and accounts

  • You must be at least 13 years old (or the age of digital consent in your region).
  • If you use the Services for an organization, you represent that you have authority to bind it.
  • You are responsible for your account credentials and all activity under your account.
  • Provide accurate information and keep it updated.
  • We may refuse, suspend, or terminate accounts that violate these Terms or create risk.

3. Your content and license to us

Your Content means audio, video, images, text, video styles, captions, profiles, and other materials you upload, submit, or generate through the Services.

  • You retain ownership of Your Content, subject to the licenses below and third-party rights.
  • You grant Cascade a worldwide, non-exclusive, royalty-free license to host, store, process, transmit, display, and create derivative works from Your Content solely as needed to operate, improve, secure, and provide the Services (including analysis, preview, export, support, and abuse prevention).
  • You represent that you have all rights, licenses, and permissions needed to upload and use Your Content, including music, footage, likenesses, trademarks, and video style materials.
  • You are solely responsible for clearing samples, publishing rights, platform rules, and any claims arising from Your Content or exports you post.

4. Acceptable use

You agree not to:

  • Violate law, intellectual property rights, privacy rights, or publicity rights
  • Upload malware, attempt unauthorized access, or disrupt the Services
  • Scrape, reverse engineer, or misuse the Services except as allowed by law
  • Resell, sublicense, or provide the Services to third parties without our permission
  • Circumvent plan limits, quotas, billing, or security controls
  • Upload unlawful, harmful, harassing, or infringing content
  • Use the Services to generate or distribute deceptive or fraudulent media for illegal purposes

5. Memberships, billing, and refunds

  • Paid plans are billed through Stripe (or another processor we designate) on a recurring basis unless canceled.
  • Prices, features, and limits may change; we will provide notice where required.
  • Unless required by law or stated otherwise at purchase, fees are non-refundable, including for unused export quotas or partial billing periods.
  • You authorize us (and our processor) to charge your payment method for applicable fees and taxes.
  • Cancel anytime from account settings or by contacting support; cancellation stops future renewals but generally does not reverse the current paid period.
  • We may suspend access for failed payments, chargebacks, or suspected fraud.

6. Free and promotional access

Free tiers, trials, monthly export allowances, or promotions may be modified or ended at any time. Abuse of free access may result in limits or account action.

7. Intellectual property

The Services, software, branding, design, and documentation are owned by Cascade or its licensors. These Terms do not transfer ownership of our IP to you. You may not copy, modify, or create derivative works of our software except as expressly allowed.

8. Feedback

If you send ideas, suggestions, or feedback, you grant us a perpetual, irrevocable, royalty-free license to use them without restriction or compensation.

9. Third-party services

The Services may rely on third parties (for example authentication, hosting, payments, email, rendering, analytics, or social platforms). Their terms and privacy policies apply to their services. We are not responsible for third-party outages or policies.

10. Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT OUTPUTS WILL BE ERROR-FREE, UNINTERRUPTED, PLATFORM-COMPLIANT, OR SUITABLE FOR ANY PARTICULAR POST OR COMMERCIAL USE.

Cascade is an editing helper. It does not replace your creative judgment, music rights clearance, or platform compliance obligations.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Cascade AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICES.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO Cascade FOR THE SERVICES IN THE 12 MONTHS BEFORE THE CLAIM OR (B) USD $100.

12. Indemnification

You will defend, indemnify, and hold harmless Cascade and its affiliates from claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising from Your Content, your use of the Services, your violation of these Terms, or your infringement of third-party rights.

13. Suspension and termination

You may stop using the Services at any time. We may suspend or terminate access immediately for breach, risk, legal reasons, or extended inactivity. Upon termination, your right to use the Services ends. Provisions that by nature should survive (including ownership, licenses already exercised for operations, disclaimers, limitations, and indemnity) will survive.

14. Changes to the Services or Terms

We may update the Services and these Terms. We will post updated Terms with a new “Last updated” date. Material changes may be communicated by email or in-product notice where appropriate. Continued use after the effective date constitutes acceptance, except where additional consent is required.

15. Governing law

These Terms are governed by the laws of the State of Delaware, USA, excluding conflict-of-law rules, unless mandatory local consumer law requires otherwise. Courts in Delaware will have exclusive jurisdiction, subject to those mandatory protections.

16. Miscellaneous

  • These Terms are the entire agreement between you and Cascade regarding the Services.
  • If a provision is unenforceable, the rest remains in effect.
  • Failure to enforce a provision is not a waiver.
  • You may not assign these Terms without our consent; we may assign them in connection with a reorganization or sale.
  • Related policies: Privacy Policy, Cookie Policy, Guidelines, and Copyright.
